BOUNCY CASTLES TORONTO RENTAL AGREEMENT, WAIVER AND RELEASE OF LIABILITY
CUSTOMER RESPONSIBILITY
The Customer must be at least 18 years old and accepts full responsibility for the rented equipment during the rental period. The Customer is responsible for communicating and enforcing all safety rules with participants, parents, guardians, guests and supervisors.
OWNERSHIP OF EQUIPMENT
All rental equipment remains the property of Bouncy Castles Toronto. The equipment may not be moved, loaned, subleased, transferred, altered or used at another location without prior written authorization.
RESPONSIBILITY DURING THE RENTAL
Once the equipment has been delivered and installed, the Customer is responsible for its proper use, protection and supervision until it is collected by Bouncy Castles Toronto.
All posted instructions and restrictions regarding capacity, age, height and weight must be followed.
IMPORTANT NOTICE — ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY
By signing this agreement, the Customer acknowledges that the use of inflatable equipment involves inherent risks. These risks include, but are not limited to, falls, collisions, improper landings, overcrowding, loss of balance, equipment movement, loss of electrical power, partial or complete deflation, weather conditions, misuse of the equipment and failure to follow safety instructions.
These risks may result in property damage, financial loss, bodily injury, serious injury, permanent disability or death. The Customer voluntarily accepts and assumes all known and unknown risks, whether foreseeable or unforeseeable, connected with the delivery, installation, presence, possession, supervision, operation, use or misuse of the rental equipment.
To the fullest extent permitted by law, the Customer releases and forever discharges Bouncy Castles Toronto, its owners, employees, contractors, delivery personnel and representatives from claims, demands, actions, damages, losses, costs or expenses arising from the rental equipment or its use.
This release includes claims arising from the ordinary negligence of Bouncy Castles Toronto, including negligent delivery, installation, inspection, maintenance, instructions, supervision, warnings or failure to warn, except where liability cannot legally be excluded or limited.
The Customer agrees to indemnify and hold harmless Bouncy Castles Toronto, its owners, employees, contractors and representatives from claims, damages, losses, liabilities, legal costs or expenses resulting from:
• The Customer’s breach of this agreement
• Inadequate adult supervision
• Failure to follow or enforce safety rules
• Misuse, abuse, alteration or unauthorized relocation of the equipment
• Damage caused by the Customer, participants, guests or other persons at the event
• Claims made by participants, guests, invitees, parents or guardians arising from the use or presence of the equipment
Nothing in this agreement releases or limits liability that cannot legally be excluded under applicable law.
ADULT SUPERVISION REQUIRED
A responsible adult aged 18 or older must directly supervise the inflatable and its participants at all times while the equipment is inflated or accessible.
The supervising adult must control entry, prevent overcrowding, separate incompatible participants and immediately stop unsafe behaviour.
GENERAL SAFETY RULES
• Participants must remove shoes, glasses, jewellery and sharp objects before entering.
• Food, beverages, gum, candy, face paint, confetti, silly string and sharp objects are prohibited.
• Smoking, vaping, alcohol, drugs and open flames are prohibited near the equipment.
• Flips, somersaults, rough play, wrestling, pushing, climbing on walls and hanging from netting are prohibited.
• Participants must enter and exit only through the designated entrance.
• The maximum capacity and all posted restrictions must be followed.
• Children of significantly different ages, sizes or abilities must use the equipment separately.
• Pets are not permitted inside or near the inflatable.
• The equipment must not be used when wet unless it was specifically rented and installed as a wet setup.
SLIDES, CLIMBING AREAS AND OBSTACLE COURSES
Participants must climb and slide one at a time unless the equipment is specifically designed for two-person competitive use.
Participants must slide feet first while seated. Head-first sliding, jumping from the top, climbing on exterior walls, blocking exits and gathering at the bottom of a slide are prohibited.
The supervising adult must control the number of participants using climbing areas, slides and obstacle-course sections and must prevent overcrowding.
LOSS OF AIR OR POWER
If the inflatable begins losing air or electrical power, everyone must exit immediately and calmly.
The Customer must stop all use, keep participants away from the equipment and contact Bouncy Castles Toronto. The equipment must not be used again until the cause has been corrected and the inflatable has been fully restored.
HEALTH AND PARTICIPANT RESTRICTIONS
Anyone who is pregnant or has a medical condition, recent injury, heart condition, back or neck problem, breathing difficulty or other condition that could be worsened by physical activity should not use the equipment.
The Customer is responsible for determining whether participants can safely use the equipment.
WEATHER AND UNSAFE CONDITIONS
The equipment must not be used during strong winds, thunderstorms, lightning, heavy rain or any other unsafe weather condition.
If unsafe conditions develop, the Customer must immediately stop use, evacuate participants and turn off the blower if instructed by Bouncy Castles Toronto.
Bouncy Castles Toronto has the final authority to delay, suspend or terminate operation when conditions are considered unsafe.
POWER SOURCE
The Customer must provide a safe, dedicated and properly functioning electrical outlet within 100 feet of the setup area unless another arrangement has been confirmed in writing.
The blower must remain connected and operating continuously while the inflatable is in use. The electrical cord and blower must be protected from water, traffic and tampering.
SETUP AREA AND ACCESS
The Customer must provide accurate information about the setup surface, dimensions, access route, stairs, gates, slopes, underground utilities, irrigation systems and other relevant conditions.
The setup area must be level, clear and free from debris, animal waste, sharp objects, overhead obstructions and underground hazards.
The Customer is responsible for obtaining permission from the property owner, condominium corporation, municipality, venue or other authority when required.
If the setup area or access conditions differ materially from the information provided, Bouncy Castles Toronto may refuse or modify the installation without liability.
ANCHORING AND EQUIPMENT
All stakes, sandbags, straps, blowers, extension cords, tarps and other setup equipment must remain in their installed positions.
The Customer and participants must not remove, loosen, cover, reposition or tamper with any anchor, blower, cord or safety component.
Any concern regarding the installation must be reported immediately to Bouncy Castles Toronto.
MOVING OR ALTERING EQUIPMENT
The Customer must not move, deflate, reinflate, repair, modify or relocate the equipment.
Only Bouncy Castles Toronto may make changes to the installation or equipment configuration.
DRY AND WET SETUPS
Water may only be used when the rental has been specifically booked and installed as a wet setup.
Hoses, sprinklers, water, soap, foam or other liquids must not be used with a dry rental. Unauthorized water use may result in cleaning, drying, repair or replacement charges.
EARLY OR PREVIOUS-DAY INSTALLATION
When equipment is installed earlier than the scheduled rental period or on the previous day, it must not be used until the agreed rental period begins unless Bouncy Castles Toronto provides written authorization.
The Customer remains responsible for protecting the equipment and preventing unauthorized access after installation.
DAMAGE, CLEANING, LOSS AND REPLACEMENT COSTS
The Customer is responsible for damage, excessive cleaning, staining, loss, theft or repair costs resulting from misuse, negligence, unauthorized relocation, prohibited substances, pets, vandalism or failure to follow this agreement.
Normal wear and damage caused solely by an equipment defect are excluded.
DELIVERY AND SETUP TIMING
Bouncy Castles Toronto guarantees that the equipment will be installed and ready before the agreed event start time.
Installation may take place shortly before the event, earlier that day or, with the Customer’s permission, on the previous day. Estimated delivery windows are provided for planning purposes and may change because of traffic, weather, access conditions or operational requirements.
CANCELLATION AND WEATHER POLICY
For cancellations made more than seven days before the event, payments may be refunded or transferred as a full credit toward another available date.
For cancellations made between seven days and 48 hours before the event, the $50 deposit is non-refundable. Any amount paid above the deposit will be refunded, or the full amount paid may be transferred as a credit toward another available date.
Cancellations made less than 48 hours before the event are normally non-refundable. Bouncy Castles Toronto may offer a partial or full future credit depending on the circumstances and availability.
If Bouncy Castles Toronto determines that weather or site conditions make installation or operation unsafe, the Customer may choose a full credit toward another available date or a full refund, including the deposit.
If the Customer requests a weather cancellation, Bouncy Castles Toronto must agree that the conditions are unsafe. Light rain, uncertain forecasts or a personal decision not to proceed do not automatically qualify for a refund.
Once delivery or installation has begun, payments are non-refundable. No refund or credit will be provided for unused rental time, early shutdown, lack of participants, loss of power supplied by the Customer or a decision not to use equipment that was delivered and installed as agreed.
Bouncy Castles Toronto has the final operational decision regarding weather and safe installation.
ACKNOWLEDGEMENT AND AGREEMENT
By signing below, the Customer confirms that:
• The Customer is at least 18 years old.
• The Customer has received and reviewed the booking confirmation.
• The Customer has carefully read and understood this agreement.
• The Customer agrees to all rental, supervision and safety requirements.
• The Customer accepts responsibility for communicating and enforcing the rules.
• The Customer specifically understands that the release includes claims involving the ordinary negligence of Bouncy Castles Toronto to the fullest extent permitted by law.
• Failure to follow this agreement may result in immediate termination of the rental without a refund.
